TERMS AND CONDITIONS

1. Acceptance of Terms

By accessing, browsing, purchasing, registering for, or using any portion of our website or services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy and any other policies incorporated by reference.

If you do not agree to these Terms, you must not access or use our website, courses, or services.

These Terms constitute a legally binding agreement between you and Preemptive Tactical LLC.

2. Eligibility to Use Our Services

By accessing or using the services provided by Preemptive Tactical LLC, you represent and warrant that you have the legal capacity to enter into a binding agreement under applicable law.

Unless otherwise authorized by a parent or legal guardian, court, educational institution, governmental agency, employer, or other authorized entity, our services are intended for individuals who are at least eighteen (18) years of age or the age of majority in their jurisdiction.

If you are registering for or participating in a course on behalf of an organization, employer, governmental agency, or other entity, you represent that you have the authority to do so.

Preemptive Tactical LLC reserves the right to refuse service, deny enrollment, suspend access, or terminate accounts when we reasonably believe a user has violated these Terms, provided false or misleading information, or is otherwise ineligible to use our services.

3. Educational Purpose of the Course

The courses, educational materials, and services provided by Preemptive Tactical LLC are intended solely for educational and informational purposes. They are designed to promote responsible firearm ownership, safe handling practices, secure storage, legal awareness, situational awareness, and informed decision-making.

Unless expressly stated otherwise in writing, completion of a course offered by Preemptive Tactical LLC does not:

  • Constitute legal advice or create an attorney-client relationship.

  • Constitute law enforcement, military, or professional firearms training.

  • Qualify an individual to possess, purchase, carry, or use a firearm.

  • Grant or guarantee eligibility for any permit, license, certification, or government approval.

  • Guarantee acceptance by any court, governmental agency, employer, or other organization.

  • Guarantee competency, proficiency, or qualification in the safe handling or operation of any firearm.

Students remain solely responsible for complying with all applicable federal, state, local, and tribal laws, regulations, court orders, employer policies, and other legal requirements applicable to their individual circumstances.

While Preemptive Tactical LLC strives to provide accurate and current educational content, laws, regulations, and governmental guidance may change over time. Participants are responsible for verifying current legal requirements applicable to their jurisdiction before relying on information presented in any course.

4. Course Enrollment and Account Responsibilities

To access certain courses or services, users may be required to create an account and provide accurate, current, and complete registration information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Preemptive Tactical LLC promptly of any unauthorized access to or use of your account.

You agree to provide accurate information during registration and to keep your account information reasonably current.

Course access is granted solely to the individual or entity that lawfully purchases or is assigned access to the course, unless otherwise authorized in writing by Preemptive Tactical LLC. Sharing login credentials, permitting unauthorized access, reproducing course access, or otherwise allowing others to use your account is prohibited.

Preemptive Tactical LLC reserves the right to verify participant identity, enrollment eligibility, course completion requirements, and any information reasonably necessary to maintain the integrity of its educational programs.

We reserve the right to suspend, restrict, or terminate access to any account that violates these Terms, compromises the security or integrity of our services, engages in fraudulent or unlawful activity, or otherwise interferes with the operation of our educational platform.

5. Payments and Fees

All prices for courses, products, and services are listed in U.S. Dollars (USD) unless otherwise stated.

Payment is required before access to paid courses or services is granted unless alternative arrangements have been expressly authorized by Preemptive Tactical LLC.

Payments are processed through independent third-party payment processors. By submitting payment information, you authorize the applicable payment processor to charge the payment method provided for the amount due, including any applicable taxes and authorized fees.

You agree to provide accurate and current billing information and to promptly update any information necessary to complete transactions.

Preemptive Tactical LLC reserves the right to modify pricing, fees, discounts, promotions, or available services at any time. Any price changes will apply prospectively and will not affect purchases completed prior to the effective date of the change.

If a payment is declined, reversed, disputed, refunded, or otherwise fails to process, Preemptive Tactical LLC may suspend or revoke access to the applicable course or service until the payment issue has been resolved.

All refunds, if applicable, are governed exclusively by the Preemptive Tactical LLC Refund Policy, which is incorporated into these Terms by reference.

Preemptive Tactical LLC reserves the right to correct typographical errors, pricing errors, technical errors, or other inadvertent inaccuracies relating to course descriptions, availability, pricing, or promotions at any time, including after an order has been submitted, to the extent permitted by applicable law.

6. Intellectual Property Rights

Unless otherwise indicated, all content made available through Preemptive Tactical LLC, including but not limited to course materials, written content, videos, audio recordings, graphics, photographs, illustrations, logos, trademarks, service marks, designs, presentations, quizzes, assessments, certificates, downloadable materials, website content, software, and other educational resources, is the property of Preemptive Tactical LLC or its licensors and is protected by applicable United States intellectual property laws.

Subject to these Terms, Preemptive Tactical LLC grants each enrolled participant a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use purchased course materials solely for the participant's personal educational purposes.

Except as expressly authorized in writing by Preemptive Tactical LLC, users may not:

  • Copy, reproduce, modify, adapt, translate, publish, distribute, transmit, display, sell, license, lease, or create derivative works from any course materials.

  • Record, photograph, screen capture, download, archive, or otherwise duplicate course content except where functionality is expressly provided by Preemptive Tactical LLC.

  • Share account credentials or provide unauthorized access to course materials.

  • Remove or alter any copyright, trademark, proprietary notice, watermark, or other ownership designation.

  • Use any content for commercial purposes or to develop competing educational materials or services.

Nothing contained in these Terms transfers ownership of any intellectual property rights to the user. All rights not expressly granted are reserved by Preemptive Tactical LLC.

Unauthorized use of our intellectual property may result in suspension or termination of access, legal action, and any other remedies available under applicable law.

7. Certificates of Completion

Certificates of Completion issued by Preemptive Tactical LLC are provided only to participants who successfully satisfy the applicable course requirements, including any required assessments, attendance, participation, or other completion criteria established for the course.

A Certificate of Completion verifies only that the participant has completed the applicable educational program in accordance with the requirements established by Preemptive Tactical LLC. A certificate does not:

  • Constitute a professional certification or occupational credential.

  • Confer any license, permit, or legal authorization.

  • Certify firearm proficiency, competency, qualification, or operational skill.

  • Guarantee acceptance by any court, governmental agency, employer, licensing authority, or other organization.

  • Guarantee compliance with any legal, regulatory, employment, or court-ordered requirement unless Preemptive Tactical LLC has expressly represented such acceptance in writing.

Preemptive Tactical LLC reserves the right to verify certificate authenticity, maintain records of issued certificates, deny issuance of a certificate when course requirements have not been satisfied, and revoke or invalidate a certificate obtained through fraud, misrepresentation, academic dishonesty, unauthorized account access, or other violations of these Terms.

Certificates remain the property of the participant; however, all certificate designs, formats, trademarks, logos, and associated intellectual property remain the exclusive property of Preemptive Tactical LLC.

8. User Conduct

By accessing or using the services provided by Preemptive Tactical LLC, you agree to use our website, courses, and educational resources in a lawful, respectful, and responsible manner.

You agree that you will not:

  • Violate any applicable federal, state, local, tribal, or international law or regulation.

  • Provide false, misleading, or fraudulent information.

  • Impersonate another person or entity or misrepresent your identity or affiliation.

  • Share account credentials or permit unauthorized access to your account.

  • Attempt to bypass, disable, or interfere with website security or access controls.

  • Upload, transmit, or distribute malicious code, viruses, or other harmful software.

  • Interfere with the operation, availability, or security of our website or services.

  • Copy, reproduce, distribute, or misuse course materials in violation of these Terms.

  • Use our website or services for any unlawful, fraudulent, abusive, or harmful purpose.

  • Engage in conduct that could damage the reputation, operations, security, or intellectual property of Preemptive Tactical LLC.

Preemptive Tactical LLC reserves the right to investigate suspected violations of these Terms and to suspend, restrict, terminate, or refuse access to any user whose conduct violates these Terms or may adversely affect our services, other users, or our legitimate business interests.

Nothing in this section limits any other rights or remedies available to Preemptive Tactical LLC under these Terms or applicable law.

9. Disclaimer of Warranties

The website, courses, educational materials, digital content, products, and services provided by Preemptive Tactical LLC are offered on an "AS IS" and "AS AVAILABLE" basis to the fullest extent permitted by applicable law.

Preemptive Tactical LLC makes no representations or warranties, express or implied, regarding the accuracy, completeness, reliability, availability, suitability, or timeliness of any information, educational content, or services provided.

To the fullest extent permitted by applicable law, Preemptive Tactical LLC expressly disclaims all warranties, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Title

  • Non-infringement

  • Any warranties arising from a course of dealing, course of performance, or usage of trade

Preemptive Tactical LLC does not warrant that:

  • The website or services will operate uninterrupted or error-free.

  • Any defects or technical issues will be corrected immediately.

  • The website or servers will be free from viruses or other harmful components.

  • Course completion will satisfy any legal, licensing, employment, educational, governmental, or court-related requirement unless expressly stated in writing.

  • Users will achieve any particular educational, professional, personal, or legal outcome through participation in our courses.

Users assume full responsibility for their decisions, actions, and reliance upon information obtained through our website or educational services.

10. Limitation of Liability

Nothing contained in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

If Preemptive Tactical LLC is found liable for any claim arising out of these Terms or the use of our services, our total aggregate liability shall not exceed the amount actually paid by the user to Preemptive Tactical LLC for the specific course, product, or service giving rise to the claim, to the fullest extent permitted by applicable law.

11. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Preemptive Tactical LLC, its owners, officers, directors, employees, instructors, contractors, affiliates, licensors, agents, and representatives from and against any claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • Your use or misuse of our website, courses, products, or services.

  • Your violation of any applicable federal, state, local, tribal, or international law, regulation, or legal requirement.

Preemptive Tactical LLC shall not be responsible for any loss, damage, delay, interruption, or other issue arising from the use of or reliance upon any third-party products or services, except to the extent required by applicable law.

13. Suspension or Termination

Preemptive Tactical LLC reserves the right, in its sole discretion and to the fullest extent permitted by applicable law, to suspend, restrict, terminate, or deny access to any website, account, course, product, or service at any time, with or without prior notice, for reasons including but not limited to:

  • Violation of these Terms and Conditions or any other applicable policies.

  • Fraudulent, deceptive, or unlawful activity.

  • Failure to comply with applicable laws or regulations.

  • Unauthorized access, account sharing, or misuse of course materials.

  • Non-payment, payment disputes, chargebacks, or other payment-related issues.

  • Conduct that threatens the security, integrity, reputation, or operation of Preemptive Tactical LLC or its users.

  • Any other reason that Preemptive Tactical LLC reasonably determines is necessary to protect its legitimate business interests or comply with legal obligations.

Termination or suspension of access does not relieve a user of any obligations incurred prior to termination, including payment obligations, intellectual property restrictions, indemnification obligations, or any other provisions that by their nature are intended to survive termination.

Preemptive Tactical LLC reserves all rights and remedies available under these Terms and applicable law.

14. Governing Law and Venue

These Terms and Conditions, and any dispute, claim, or controversy arising out of or relating to the website, courses, products, services, or the relationship between you and Preemptive Tactical LLC, shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles.

To the fullest extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in a state or federal court of competent jurisdiction located within the State of Nevada. By using our website or services, you consent to the personal jurisdiction and venue of such courts.

Nothing in these Terms shall prevent Preemptive Tactical LLC from seeking temporary restraining orders, preliminary injunctions, permanent injunctions, or other equitable relief in any court of competent jurisdiction when necessary to protect its intellectual property, confidential information, business operations, or other legal rights.

If any provision of this section is determined to be unenforceable under applicable law, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

Your continued access to or use of our website, courses, products, or services after the effective date of any revised Terms constitutes your acceptance of the updated Terms.

If you do not agree to the revised Terms, you must discontinue use of our website and services.

To the extent permitted by applicable law, any invalid or unenforceable provision shall be interpreted or modified by the court only to the extent necessary to make the provision enforceable while preserving its original intent as closely as possible.
